TERMS OF SERVICE

General Terms of Service
By commissioning me, you are agreeing to these terms. You are also agreeing that you are over the age of 18, and are otherwise entering into a legal contract. I, Cassene, am only responsible for providing what is requested.Relationships
1. You, the commissioner, are commissioning me, Cassene, as an independent, freelance artist to create a base edited image or original work of art.
2. I have the right to refuse an order at any given time, with or without reason.
3. I have the right to provide work to other commissioners during the completion of your order.
4. You absolutely cannot remove, hide, cover, crop, or alter any signatures and/or watermarks placed on your order.
5. Upon completion you will be granted permission for personal use.
6. I have the right to post and copy my work, even if it is a copyright of your character.
7. If you, the commissioner, wish to get any work done of another's character(s), you must provide proof of your relations to that person and evidence that he/she/they gave you permission to use their character in any service provided by me, Cassene.
8. You, the commissioner, have the right to re-post any service I have provided to you for personal use to your galleries as well as make minor alterations to the commission (e.g add text, border, stickers, etc.) as long as you credit me, Cassene, as the artist.
9. You have the right to print your commission and make copies for person use only. You are not allowed to sell copies or use any of my work to make a profit.
10. You, the commissioner, understand that my commissions will be wing-its/pre-pose bases for chibis unless a pose is provided at the initial commission request.Payment
1. I accept payment through Cashapp, Venmo, Stripe, Ko-fi, and Gpay. Paypal can be accepted however, I prefer not to use it.
2. Payment must be paid in full in advance unless otherwise discussed.
3. Split payments are prohibited unless other participants' character(s) partake in the piece.
4. Payment plans are accepted if payment exceeds $100.00 USD and may not last longer than six (6) months unless otherwise discussed.
5. I do not accept e-checks.
6. You, the commissioner, understand that you are responsible for paying any extra fees that may be charged. This includes, but is not limited to, additional fees for extra characters, complex designs, etc.)
7. You must pay within 48 hours of receiving the invoice and/or payment request or your order will be considered canceled.Revisions
1. WIPs (Work in Progress) will be provided during each stage of the commissioning process until the lining process for any piece of art owed. After the lining WIP is sent out, you will not see your owed art until completion. I do not, however, provide WIPs for sketch commissions. You won't get to see the sketched commission until it is completed.
2. If I, Cassene, make mistakes based on the references provided, I will gladly fix them for you.
3. Any additional information provided after the initial inquiry will not be held accountable by myself, the artist, and will not be revised.
4. I will not "redo" a whole order if you are unhappy with it. Please be sure to look in my gallery to see my style before you order from me.Deadlines/Timeframes
1. I, the artist, cannot and will not work under any deadlines or timeframes for any reason.
2. I, the artist, can provide you with an estimate on how long I believe it may take, however, it does not mean that is the set timeframe it will take to complete your order.Refunds/Cancellations
1. If for whatever reason I, Cassene, cannot start on your commission, you will receive a full refund.
2. You, the commissioner, are not allowed to request a refund and/or cancellation if you simply "changed your mind" about a commission.
3. If you request a refund during the sketching stage with a valid reason, you will get a full refund with no questions asked.
4. If you request a refund after the inking stage with a valid reason, I, the artist, get to keep 50% of the total price.
5. If I, the artist, need to refund you due to personal reasons, you will receive a full refund.
6. Bases, Adoptables, YCH's, and Auctions are non-refundable (depending on the circumstances, if the adoptable/design was purchased directly through me, Cassene, the commissioner may be refunded).
8. You, the commissioner, are not allowed to file a charge-back whatsoever without talking to me first. If you do, you will be automatically blacklisted and not allowed to participate in any of my freebie, commission, or trade events.
9. Any hiding/editing of your comment that claims a commission spot, adopt, or YCH will result in you being blacklisted with or without warning.
10. Any refund requests requested without a valid reason can and will be denied.
*The list of what I, the artist, considers a valid reason can be found under the "Valid Reasoning" section located at the end of my Terms of Service.Adoptables/Designs
1. I can deny you access at any given time with or without reason.
2. You, the commissioner, may never claim the art and/or design as your own.
3. You, the commissioner, must credit me, Cassene, as the original artist.
4. You, the commissioner, are allowed to resell an adopt and/or design if and only if the adopt and/or design is being sold for no greater than the original amount it was bought, unless you, the commissioner, purchased additional art of that character (freebie art, gift art, or base fills drawn of the character and/or design does not apply).
5. I, the artist, can and will blacklist you, if I see that they are not being used properly and/or if I see that my terms of service are being violated.
6. Any form of theft of an adoptable will result in you being blacklisted. If you refuse to take down my stolen work, I can and will take you to court for copyright violations.
7. Under NO circumstances are my adopts/designs to be removed from toyhou.se and reuploaded. The original adopt/design character is to remain under Cassene at TH with transfer logs remaining on TH. Violators will be placed on the permanent blacklisted.
8. Adoptables are non-refundable (depending on the circumstances, if an adoptable and/or design was purchased directly from me, Cassene, the commissioner may be refunded).Auctions
1. I can deny you access at any given time with or without reason.
2. No false bids.
3. No canceling or hiding bids (do not bid if you do not have the funds).
4. No editing bids.
5. Adoptable rules apply to all adoptable and/or design auctions.
6. The highest bidder must pay within 48 hours from the auction ending and must provide proof of payment.
7. If the highest bidder does not pay, the next runner-up must pay within 48 hours from the time they are contacted and must provide proof of payment.
8. Auto-buyers (AB) must pay within 24 hours of the auction ending or within being contacted and must provide proof of payment.
9. Refusal to pay will land you a spot on my blacklist.
10. You must credit me, the artist, for any work provided.
11. Auctions are non-refundable (depending on the circumstances, if an adoptable and/or design was purchased directly from me, Cassene, the commissioner may be refunded).Bases/Lines
1. I can deny you access at any given time with or without reason.
2. You can use any files purchased from me, the artist, for yourself.
3. You may not share any files given to you by me, Cassene (this includes the sharing of base, lines, or any layers), with anyone other than yourself (this includes friends, family, spouses, etc).
4. You must credit me, Cassene, for the base and can only credit yourself, the commissioner, for the edits (such as design, additional lines added, etc).
5. Do not sell the base even if you added, edited, or altered the base in any way, shape, or form.
6. You may use the base for commissions and/or adoptables unless otherwise stated.
7. You may not create any base add-ons for profit for any free or purchased bases provided by, Cassene.
8. Bases and/or lines are non-refundable (depending on the circumstances, if a base and/or line was purchased directly from me, Cassene, the commissioner may be refunded).Blacklist
1. You, the commissioner, acknowledge that you have read the entirety of my terms of service and understand that breaking any of these terms and conditions can and will land you a spot on my blacklist.
2. You, the commissioner, acknowledge that you will only receive three warnings before being permanently blacklisted.
- STRIKE ONE gets you a warning.
- STRIKE TWO gets you a temporary blacklist.
- STRIKE THREE gets you a permanent spot on my blacklist.
3. You, the commissioner, are aware that my blacklist will be posted publicly for all to see.
4. You may not sell, give/gift, purchase for, or trade any of my bases, lines, adoptables, and/or designs to anyone on my blacklist. If I find that you did, you will be placed on the permanent blacklist without warning.Confidentiality
You, the commissioner, and I, the artist, both agree that we will not knowingly share any private information gained during and after use of this service. The exception to this is any disclosure required to complete the service. This includes any information that could reasonably be deemed personally identifiable (such as names, emails, addresses, etc.) as well as account information, including but not limited to discord, facebook, paypal, bank accounts, or others that may apply that are not listed or stated here.Grant of Rights
1. Once the final artwork is completed, I will grant you a non-commercial license to: upload to your gallery(ies) and other sharing platforms with credit to the artist, Cassene.
2. You do not have the right to use this artwork for personal gain, financial opportunity, or otherwise.
3. In the event of a partial refund or otherwise, you are giving up your rights to any works already started. You may no use any of my artwork or WIPs unless the commission is completed in full, and the contract is considered fulfilled.
4. You agree that a charge-back or reversal of payment constitutes as a breach of these terms. This grant of rights will be revoked if you do so.What I WILL Draw
I will draw pretty much anything that is not on my "What I Won't Draw" list.What I WON'T Draw
- Discriminating objects and/or behavior
- Baby/diaper/cub furs
- Robotic/Complex Metal
- Vomit
- Scat
- Vore
- Watersports
- Sexual activities with underage characters
- Certain kink fetishes
- NSFW Chibis (SFW only!)
If you are unsure as to what I will and/or won't draw, feel free to ask.Valid Reasoning
I, Cassene, agree and understand that in pursuant to the "Refund/Cancellations" section of my Terms of Service, I will provide all necessary and full refunds to you, the commissioner, if provided with valid reasoning along with your request for a refund and/or cancellation of your commission by me, the artist. This includes, but are not limited to the following:
1. If you are experiencing financial issues where you cannot pay a bill.
2. I, the artist, have taken 6 or more months to complete a small project.
3. You are going through any sort of emergency in your personal life that you can provide evidence of.
